CHATTANOOGA, Tenn. (AP) -- The Chattanooga Times Free Press will not appeal a court decision allowing a judge to keep his recording of embarrassing graphic fantasies private.
Former Circuit Judge John Hagler of Cleveland and his attorney, Roger Jenne, did not return the newspaper's request for comment Monday.
Hamilton County Chancellor Frank Brown ruled Jan. 17 in the open records case that Hagler's recording did not relate to his formal duties and that Chattanooga police having the audiotape in their files did not make it a public record.
Times Free Press publisher and executive editor Tom Griscom said there will be no appeal of the unfavorable ruling because it will have little impact on future open records cases.
