Kidnapping, rape charges dropped against Jansen
Prosecutors have dropped the kidnapping and rape charges against the man accused of abducting a woman in Atlanta and taking her to a Seveir County, according to the office of Defense Attorney Don Bosch.

KNOXVILLE, Tenn. (WVLT) -- Prosecutors have dropped the kidnapping and rape charges against the man accused of abducting a woman in Atlanta and taking her to a Seveir County, according to the office of Defense Attorney Don Bosch.
David Jansen, 47, was arrested after a pizza delivery man called 911 after he saw a woman tied up inside a rental cabin in Gatlinburg.
Assistant Attorney General Steve Hawkins says the credibility of the victim is in doubt., and , based on all the information, they likely would not be able to get a conviction in the case, nor would they try.
"As District Attorneys, our job is to seek justice, not convictions," a release from Sevier County District Attorney James B. Dunn states. "Justice requires us to dismiss these charges dues to the (alleged) victim's credibility and other evidence."
However, Hawkins says prosecutors are not going to seek prosecution of the alleged victim, either. They feel they would not be able to get a conviction beyond a reasonable doubt.
"(The alleged victim) insists that her allegations are true," the release states.
According to court documents, Jansen met the woman at an Atlanta strip club called Tattle Tales. They took pictures together, and Jansen says she later e-mailed them to him, documents say.
Jansen says she emailed him other pictures, too.
In Jansen's handwritten affidavit, he claims she told him one of her fantasies was bondage. She asked him to pick her up while she was jogging and to bring rope, duct tape, a knife and sex toys.
Jansen and the woman stopped three times on their way from Atlanta to Gatlinburg. In surveillance video from one stop, you can see Jansen leave his alleged captive unattended for about seven minutes.
Lawyers say she had plenty of time to get someone's attention. There were at least nine other vehicles in the gas station parking lot.
And inside the store, Jansen's defense team says it's obvious he wasn't in a hurry to get in and out.
The defense also relied on the woman's potentially incriminating past.
In other instances, she allegedly once called for help saying she had been stabbed, and twice filed reports saying she had been raped.
Those allegations resulted in charges of filing a false police report.
