Roane County deputy cleared in June 2009 fatal shooting
The Roane County Grand Jury voted unanimously on Tuesday against indicting the deputy who fatally shot a Kingston man last spring.

ROANE COUNTY, Tenn. (WVLT) – The Roane County Grand Jury voted unanimously on Tuesday against indicting the deputy who fatally shot a Kingston man last spring.
The case revolved around Deputy Dustin Hensley and David Dickey. Hensley responded to a complaint of gunshots being fired from Dickey’s Quarry Road home on June 6th.
According to the Tennessee Bureau of Investigation, Dickey told the deputy that he had been “shooting at deer in his potato patch.” The deputy then informed him that he should not be firing his gun since it wasn’t deer season and because his house was close to others, it could be considered reckless endangerment.
According to the official TBI report, Dickey responded by walking from his front door toward the deputy with a 9 mm pistol in his hand. Hensley told investigators the man then said, “let me tell you something. I’ll kill you.”
The deputy pulled his .357 service weapon from its holster and fired seven shots at Dickey, striking him three times in the man’s abdomen and chest. He was rushed to the University of Tennessee Medical Center where he later died from his wounds.
Dickey never fired at the deputy, but an investigation of his home turned up other firearms and numerous cases of ammunition, power and reloading equipment. TBI agents also interviewed Dickey’s brother and neighbor and learned that a few years ago, police arrived to interview him about shooting a pair of another neighbor’s dogs to death, and Dickey had a gun in his hand during the initial questioning. He also allegedly had pulled a gun on a person and threatened to shoot them in the head.
Besides hearing the full TBI report, the grand jury also heard testimony from a TBI Special Agent and statements by Deputy Hensley, Dickey’s other neighbors and people with information about the shooting. They were also shown photos and a video of the crime scene.
Roane County Sheriff Jack Stockton had originally put Hensley on administrative leave, but later brought him back to desk duty before letting him back out on the road with a supervisor. According to a news release from the Ninth Judicial District, Sheriff Stockton will clear the deputy for duty and put him back out on regular patrol.
