West Knoxville Shoney's murder suspect arrested
The man wanted for allegedly killing Dyishun Foust, 26, in a West Knoxville Shoney's parking lot has been arrested, police sources told Volunteer TV's Pete Michaels and Knoxville Police Spokesman Darrell DeBusk later confirmed in an email.
Police issued a warrant for Deadrick E. Garrett, 21, Monday.

UPDATE 5/3/09 4:51 p.m.: KNOXVILLE, Tenn. (WVLT) -- The man wanted for allegedly killing Dyishun Foust, 26, in a West Knoxville Shoney's parking lot has been arrested, police sources told Volunteer TV's Pete Michaels and Knoxville Police Spokesman Darrell DeBusk later confirmed in an email.
Police issued a first degree murder warrant for Deadrick E. Garrett, 21, Monday.
He turned himself into to Knoxville Police Investigators Jeff Day and Nevin Long around 4:45 Monday afternoon, according to DeBusk.
Garrett is also facing a 2007 homicide charge in which he's accused of stabbing his half-brother to death in West Knoxville.

UPDATE 5/4/09 11:24 a.m.: KNOXVILLE, Tenn. (WVLT) -- Knoxville Police have issued a first degree murder warrant for a man wanted in connection with the death of another man in a West Knoxville Shoney's parking lot.
Deadrick E. Garrett, 21, is accused of gunning down Dyishun Foust, 26, on Saturday, May 2.
Garrett is out on bond awaiting trial on homicide charges stemming from a stabbing he allegedly committed on Morrell Road in July 2007.
Garrett allegedly stabbed his half brother, Rashad Miller, multiple during a confrontation in which Garrett accused Miller of raping a female relative of Garrett. Miller later died at UT Medical Center.
Once arrested, Garrett will be held on a $1 million bond.

KNOXVILLE, Tenn. (WVLT) -- Knoxville Police have identified the man shot and killed in the parking lot of the Shoney's at Kingston Pike and Walker Springs Road in West Knoxville.
Police identify the victim as Dyisshon Foust, 26, of Knoxville.
Knoxville police say the shooting happened around 6:20 pm, in a busy area, in front of a lot of people.
"I looked over and he fell to the ground and the car drove off, so I called 911," said one witness who asked not to be identified.
"We were riding by and we saw some guy lying face down and we thought maybe somebody had gotten in a fight or something," said Astin Roberson, another witness.
"We heard the shots," Roberson continued, "but by that time the police were on the way. So I guess while they were fighting, somebody called the cops. They left right before the cops got here," he said.
There were a lot of eyes, but there is still no suspect in custody.
"The investigation is fresh and we've just started," said KPD Captain David Rausch.
Knoxville police say they have some surveillance video, but they're going to rely heavily on statements from the people who saw the murder.
"It was two guys, they kind of jumped him," Roberson said.
"It was a yellowish, tannish station wagon," added another.
Witnesses say they saw a fight: two against one.
"As best we know, there is a possibility there were two people involved," Captain Rausch said.
Witnesses say they heard two shots fired.
But by the time help arrived, it was too late for the victim.
And the yellow Volvo station wagon was no where in sight.
"A witness followed it, to get the description of the vehicle, didn't get the tag," Rausch said.

KNOXVILLE, Tenn. (WVLT) -- Knoxville police are looking for a man driving a small, yellow SUV after they said he shot and killed another man in a parking lot.
Dispatchers tell Volunteer News, two black men were fighting outside the Shoney's Family Restaurant at 8529 Kingston Pike around 6:20 pm Saturday when one man was shot.
The victim died from his injuries. The suspect was last seen driving westbound on Kingston Pike.

I can't say I ever met or got to know Dyishun Foust, but I did get to meet Deadrick. He was a friend, he was a mellow, laid back guy with his head on right. I never once saw him get angry or wish anything bad upon anyone. He isn't a monster, or a bad person. In my opinion, if Deadrick had killed this man there must've been bad blood and it must've been a last resort. I'm not saying Foust was a bad person, I couldn't say that because I never knew him, but something must've happened for Deadrick to react the way he did. I hope Deadrick finds hope, and I hope Dyishun Foust finds peace.
